TERMS AND CONDITIONS OF SALE

1. H.B. Evelyo Ltd., trading as Hattiers Rum, supplies rums subject to stock remaining on hand. Prices are subject to market fluctuation and we reserve the right to amend prices of goods not already invoiced.

2. ORDERS & DELIVERY

2.1. The minimum order size is six cases, each of six bottles. Minimum orders may comprise of one case of one rum from Hattiers’ range and one case of another. Mixed cases are not offered.

2.2. All orders received by 10.30am, are scheduled for delivery within 5 working days. Delivery charges are added to orders. Additional  charges may be applied apply to rush orders and weekend deliveries.

2.3. Advice of non-delivery must be received in writing within 5 days of the invoice date; otherwise The H.B. Evelyo Ltd cannot accept claims or responsibility for loss. Goods must be signed for legibly on receipt as either being in good condition or damaged and any such damage advised to us within 3 days.

3. NEW ACCOUNTS

3.1 Goods are released for sale upon payment of our pro-forma invoice, unless credit terms have been agreed and the buyer’s historic payment performance meets those agreed terms. Credit facilities will be considered, for any buyer, after provision of satisfactory bank and two trade references. H.B. Evelyo Ltd., will set a maximum limit to any credit offered to any buyer.

3.2 Prices are quoted on Duty Paid basis, exclusive of Value Added Tax, where that duty is £28.74 per litre of pure alcohol on the date of the current version of these TERMS AND CONDITIONS OF SALE. In the event of any increases in duties or introduction of tariffs all prices will be amended, with immediate effect, to include those duties or tariffs. Invoices are payable upon shipment unless a credit facility has been granted. For credit customers payment is to be by BACS no later than 10 working days from date of shipment as shown on the invoice.

3.3. H.B. Evelyo Ltd reserves the right to pass all accounts that fall into arrears outside the normal Terms & Conditions (10 working days from the invoice date) to a third party. We will add interest at a rate of 20% of the amount due. A charge of £25.00 plus VAT will be added to every returned cheque or to any bank charges incurred. In the case of repossession an additional £50.00 plus VAT will be added to cover costs in addition to interest charges.

 

4. FORCE MAJEURE

Hattiers Rum Ltd shall not be liable for any failure to fulfil any terms of any transaction governed by these conditions of sale if fulfilment has been delayed, hindered or prevented by any circumstances whatsoever which is not directly within their control.

 

5. RISK & TITLE

The goods shall be at the buyer’s risk from the moment of delivery. All goods remain the property of H.B. Evelyo Ltd until payment in full has been received. Until such payment, the customer shall hold the goods and all items incorporating the goods as trustees for H.B. Evelyo Ltd and must not remove, alter or deface any identification mark placed on the goods or their packaging by us, and shall clearly identify all items incorporating the goods as belonging to H.B. Evelyo Ltd.

In the event of non-payment, H.B. Evelyo Ltd shall be entitled, in addition to other rights, to enter any premises where goods may be and recover possession of them.

 

6. DATA PROTECTION ACT 1984

To comply with the Act, H.B. Evelyo Ltd is required to inform you that it has recorded your name and address on the computer for the sole purpose of sending you its price lists, invoices, statements of account and any other information. Your name and address will not be given to any third party.

 

ORDERS ACCEPTED ONLY ON CUSTOMERS’ AGREEMENT TO THE ABOVE CONDITIONS.

 

Buyer’s purchasing conditions are rejected.
